| dc.description.abstract | การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาที่เกิดจากการบังคับใช้กฎหมายควบคุมอาคาร พ.ศ. 2522 ของประชาชน และเพื่อศึกษาแนวทางมาตรการแก้ไขและส่งเสริมให้เกิดการปฏิบัติตามพระราชบัญญัติควบคุมอาคาร พ.ศ. 2522 ในการขออนุญาตก่อสร้างดัดแปลงรื้อถอนอาคารของเทศบาลตําบลในอําเภอเมือง จังหวัดระยอง ประกอบด้วย เทศบาลตําบลนํ้าคอก เทศบาลตําบลแกลงกระเฉด เทศบาลตําบลบ้านเพ เทศบาลตําบลเชิงเนิน เทศบาลตําบลเนินพระ และเทศบาลตําบลทับมาใช้แบบสอบถามเป็นเครื่องมือในการวิจัยสอบถามกลุ่มตัวอย่าง 2 กลุ่ม คือ กลุ่มเจ้าหน้าที่รัฐผู้บังคับใช้กฎหมายควบคุมอาคาร จํานวน 20 คน และกลุ่มประชาชนผู้ปฏิบัติตามกฎหมายควบคุมอาคารที่ขออนุญาตก่อสร้างดัดแปลง และรื้อถอนในปี งบประมาณ พ.ศ. 2560-2561 จํานวน 271 คน วิเคราะห์ผลด้วยสถิติเชิงพรรณนานําเสนอในรูปแบบความถี่ ร้อยละ ค่าเฉลี่ย และส่วนเบี่ยงเบนมาตรฐาน ผลการศึกษา พบว่า 1) กลุ่มเจ้าหน้าที่รัฐผู้บังคับใช้กฎหมาย ผลการทดสอบความรู้ความเข้าใจเกี่ยวกับกฎหมายควบคุมอาคาร จํานวน 15 ข้อ กลุ่มตัวอย่างมีคะแนนเฉลี่ย 10.07 (SD = 1.65) เทียบกับเกณฑ์มาตรฐานอยู่ในเกณฑ์พอใช้ และกลุ่มเจ้าหน้าที่รัฐมีความต้องการให้เทศบาลมีผังขั้นตอนการให้บริการชัดเจนมากที่สุด รองลงมาได้แก่ มีการประชาสัมพันธ์การปฏิบัติตามกฎหมายควบคุมอาคารจัดทําทะเบียนควบคุมคําขอรับใบอนุญาตฯ และจัดทําทะเบียนคุม ใบอนุญาต ฯ 2) กลุ่มประชาชนผู้ปฏิบัติตามกฎหมายควบคุมอาคาร ปัญหาที่พบจาการขออนุญาต ส่วนใหญ่เป็นปัญหาการขออนุญาตก่อสร้าง ร้อยละ 85.6 ปัญหาการขออนุญาตดัดแปลงอาคาร ร้อยละ 11.1 และปัญหาการขออนุญาตรื้อถอนอาคาร ร้อยละ 3.3 โดยปัญหาทั้ง 3 กรณี เกิดจากการไม่ขออนุญาตก่อสร้างดัดแปลง หรือรื้อถอน ไม่ทราบว่าต้องขออนุญาตก่อสร้าง ดัดแปลงและรื้อถอน และไม่ทราบว่าต้องใช้เอกสารใดบ้างในการขออนุญาตก่อสร้างดัดแปลงและรื้อถอน ความพึงพอใจในการรับบริการขออนุญาตปลูกสร้างดัดแปลง และรื้อถอนอาคาร ด้านค่าธรรมเนียมที่เรียกเก็บ ด้านความรวดเร็ว ด้านบริการของพนักงาน และด้านกระบวนการขั้นตอนการให้บริการ มีความพึงพอใจในระดับมากผลการสอบถามความต้องการและ ข้อเสนอแนะของกลุ่มประชาชนผู้ปฏิบัติตามกฎหมาย มีความต้องการให้เทศบาลจัดทําทะเบียนคุมใบอนุญาตมากที่สุด รองลงมาได้แก่มีการฝึกอบรมทบทวนกฎหมายก่อสร้างอย่างชัดเจน มีจํานวนเจ้าหน้าที่เหมาะสมกับการปฏิบัติงาน และมีการกระตุ้นให้ประชาชนปฏิบัติตามกฎหมายอย่างเคร่งครัด | |

| dc.description.abstractalternative | The purpose of this research was to problems of arising from the enforcement of building control law 1979 of the people and to study ways to correct and promote the implementation of the Building Control Act 1979 on the request for construction, modification, demolition of the building of Tambon Municipality in Muang District, Rayong. It consists of Nam Khok, Klaeng Kachet, Banphe, Choeng Noen, Noen Phra and Thap Ma Municipal. Using the questionnaire as a research tool, two groups of samples were investigated. First were 20 state officers in the building control department. Second were 271 people applying for construction permits, modified and demolished in the fiscal year 2017-2018. The collected data were analyzed with descriptive statistics using frequency, percentage, mean, and standard deviation.State officers were tested with 15 questions on the building control law usage enforce in the districts. The results showed that the officers have known the building control law with mean score of 10.07 and standard deviation of 1.65, corresponding to the fair level comparing to the standard level. Suggestion from these officers to the municipality for improving the services were to have a clear service flow chart, and registration application control system for the building control unit. On people who applied for building control services, the most problems frequently occurred were applied for the building constructions with 85.6%. Applying for modified building and demolish building were second and third problems with 11.1% and 3.3%, respectively. Main reasons causing these three problems could be identified as lacking knowledge of the building code law. Satisfaction on the service to the building control departments surveying from people was shown with a high level. Suggestions from people in order to improve the performance of building control unit were concentrated on obvious application flow chart, registration control system, and enough state building staffs and engineers, correspondingly. | |
