กระบวนการยุติธรรมทางอาญาและฐานข้อมูลดีเอ็นเอแห่งชาติ: ประสบการณ์ประเทศสมาชิกสหภาพยุโรป

Abstract

สารรหัสพันธุกรรมดีเอ็นเอ (Deoxyribonucleic acid (DNA)) ถูกนำมาใช้ประโยชน์ต่อกระบวนการยุติธรรมของนานาประเทศ รวมทั้งประเทศสหราชอาณาจักร เยอรมนี โปรตุเกส และประเทศไทย ประเทศโปรตุเกสเป็นหนึ่งในสมาชิกสหภาพยุโรปได้ดำเนินการตามหลักเกณฑ์ตามมาตรฐานสากล เพื่อให้เกิดฐานข้อมูลเดือนเองชาติเช่นเดียวกับประเทศสมาชิกอื่นๆ อย่างไรก็ตามการเกิดกฎหมายเกี่ยวกับฐานข้อมูลดีเอ็นเอนั้น ต้องมีการให้ความสำคัญกับตัวบทกฎหมาย และจริยธรรมของการนำประโยชน์ของดีเอ็นเอมาใช้ในคดีอาญา ประเทศโปรตุเกสได้ออกกฎหมายสารข้อมูลดีเอ็นเอแห่งชาติมาใช้เรียบร้อยแล้วตั้งแต่ปี ค.ศ. 2008 ซึ่งบังคับใช้ทั้งคดีแพ่ง และคดีอาญา สำหรับประเทศไทยนั้น ยังไม่มีตัวบทกฎหมายดีเอ็นเอ และกฎหมายฐานข้อมูลดีเอ็นเอแห่งชาติ เช่นฐานข้อมูลแห่งชาติเป็นเครื่องมือที่มีประโยชน์และอำนวยต่อหน่วยงานยุติธรรมทางอาญาในการนำมาใช้เพื่อประโยชน์ในการป้องกัน และปราบปรามคดีอาญาที่เกิดขึ้นในสังคม ในขณะเดียวกัน ผู้บังคับใช้กฎหมายก็ต้องคุ้มครองสิทธิขั้นพื้นฐานของประชาชนด้วย DNA or Deoxyribonucleic acid testing is being used for the benefit of criminal justice system throughout the world, including the United Kingdom, Germany, Portugal and Thailand. Portugal is one of the EU Member States which has instituted comprehensive rules to the operation of its National DNA Database in accordance with international standards. A National DNA Database law must focus on the legislation and ethics of the advantages of DNA use. In 2008, the Portuguese legislature enacted successfully the National DNA Database which applies to both civil and criminal cases. In Thailand there is no specific legislation on the use of DNA or the implementation of the National DNA Database Act. The National DNA Database is a useful tool and facility for those agencies whose purpose is criminal prosecution. It must always been borne in mind that a balance must to be struck between the rights of the individual and the pressing needs of law enforcement agencies. A prime responsibility is the respect of Basic Human Rights.
