dc.description.abstract	การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาระดับความเชื่อมั่นของแรงงานข้ามชาติที่มีต่อกระบวนการยุติธรรมไทยชั้นสอบสวน เพื่อศึกษาปัจจัยที่ส่งผลกระทบต่อความเชื่อมั่นของแรงงานข้ามชาติที่มีต่อกระบวนการยุติธรรมไทยชั้นสอบสวน และเพื่อเสนอแนะแนวทางในการปรับปรุงกระบวนการยุติธรรมไทยชั้นสอบสวน การวิจัยครั้งนี้เป็นเชิงปริมาณ โดยใช้แบบสอบถามเป็นเครื่องมือในการเก็บรวบรวมข้อมูลกับแรงงานข้ามชาติที่ได้รับ อนุญาตทำงานในจังหวัดระนองที่มีอายุตั้งแต่ 18 ปีขึ้นไป จำนวน 396 คน ซึ่งสถิติที่ใช้ในการวิเคราะห์ข้อมูล คือ ความถี่ ร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน สัมประสิทธิ์ความแปรผัน ค่าความเบ้ ค่าความโด่ง การวิเคราะห์ สหสัมพันธ์เพียร์สัน และการวิเคราะห์ถดถอยเชิงพหุคูณ ผลการศึกษาพบว่า ระดับความเชื่อมั่นของแรงงานข้ามชาติที่มีต่อกระบวนการยุติธรรมไทยชั้นสอบสวน ภาพรวมอยู่ในระดับปานกลางโดยแรงงานข้ามชาติมีความเชื่อมั่นด้านความรับผิดชอบมากที่สุด อยู่ในระดับมากรองลงมา คือ ด้านนิติธรรม อยู่ในระดับปานกลาง ด้านความโปร่งใส อยู่ในระดับปานกลางและด้านคุณธรรม อยู่ในระดับปานกลาง ตามลำดับ ในส่วนของปัจจัยที่ส่งผลกระทบต่อความเชื่อมั่นของแรงงานข้ามชาติที่มีต่อกระบวนการยุติธรรมไทยชั้นสอบสวน คือ ทัศนคติที่มีต่อกระบวนการยุติธรรมไทยชั้นสอบสวนมีอิทธิพลมากที่สุด มีอิทธิพลเชิงบวก (Beta=0.44) รองลงมา คือ การรับรู้ความสามารถในการปฏิบัติงานของบุคลากรในกระบวนการยุติธรรมไทยชั้นสอบสวน มีอิทธิพลเชิงบวก(Beta=0.27) การรับรู้ข้อมูลข่าวสารเกี่ยวกับกระบวนการยุติธรรมไทยชั้นสอบสวน มีอิทธิพลเชิงบวก(Beta=0.10) และประสบการณ์เกี่ยวกับกระบวนการยุติธรรมไทยชั้นสอบสวน มีอิทธิพลเชิงลบ (Beta=-0.09) โดยแรงงานข้ามชาติได้เสนอแนะแนวทางในการปรับปรุงกระบวนการยุติธรรมไทยชั้นสอบสวน คือ ควรทบทวนและแก้ไขข้อบกพร่องของกฎหมายที่เกี่ยวข้องกับแรงงานข้ามชาติให้ดีขึ้น เท่าเทียม และยุติธรรม โดยในข้อหาที่เกี่ยวกับแรงงานข้ามชาติควรมีล่ามหรือ เจ้าหน้าที่ที่สามารถอธิบายให้ทั้งสองฝ่ายเข้าใจและปฏิบัติตามได้ในส่วนของเจ้าหน้าที่ควรเคารพและปฏิบัติตามกฎหมายอย่างซื่อตรงถูกต้องและตัดสินใจเป็นกลางควรปฏิบัติงานด้วยการให้เกียรติไม่ดูถูกกดขี่ใช้ความรุนแรง หรือยัดเยียดคดีและต้องอำนวยความยุติธรรมอย่างเท่าเทียม ในกรณีที่เกิดปัญหาฉุกเฉินขึ้น เจ้าหน้าที่ไม่ควรละเลยหน้าที่ในการปฏิบัติงาน และควรมีการชี้แจงรายละเอียดของขั้นตอนการดำเนินงานอย่างเปิดเผยเป็นกลางและถูกต้อง

dc.description.abstractalternative	This Research was aimed at studying the level of confidence of transnational workers toward Thai justice process at the investigation level, studying factors affecting the confidence of transnational workers toward Thai justice process at the investigation level and proposing guidelines for improvement of the Thai justice process at the investigation level.This Research was quantitative research using questionnaires as tool for collection of data from transnational workers being permitted to work in Ranong Province, aged 18 years old or above, totally 396 people.Statistics used in data analysis included Frequency, Percentage, Mean, Standard Deviation, Coefficient of Variation, Skewness, Kurtosis, Pearson Correlation and Multiple Regression. According to the study result, it was found that the overall level of confidence of transnational workers toward Thai justice process at the investigation level was at the medium level; whereby, transnational workers had confidence in responsibilities at the high level, followed by confidence in the rule of law at the medium level, confidence in transparency at the medium level, and confidence in merits at the medium level, respectively. Meanwhile, factors affecting the confidence of transnational workers toward Thai justice process at the investigation level were attitudes towards the Thai justice process at the investigation level with the most positive influence (Beta = 0.44), followed by the recognition of abilities of performance of works of personnel in the Thai justice process at the investigation level with positive influence (Beta = 0.27), recognition of information relating to the Thai justice process at the investigation level with positive influence (Beta = 0.10), and experiences relating to the Thai justice process at the investigation level with negative influence (Beta = 0.09); whereby, transnational workers proposed guidelines for improvement of the Thai justice process at the investigation level, i.e., errors of the laws relating to transnational workers should be reviewed and remedied in an equal and fair manner; and in legal charges relating to transnational workers, an interpreter or personnel should be provided to explain to both parties for understanding and compliance therewith; meanwhile, the authorities should respect and comply with the laws honestly and correctly, and decisions made should be neutral, and in the performance of works, they should give respects and should avoid scornfulness, oppression, use of violence or forcing of cases, and should have equal administration of justice. In case of emergency, the authorities should not breach their duties in the performance of works and should openly clarify details of the work processes in a neutral and correct manner.
