dc.description.abstract	งานนิพนธ์ฉบับนี่มีวัตถุประสงค์เพื่อศึกษาปัญหาการบริหารจัดการของคณะกรรมการหมู่บ้านจัดสรรตามพระราชบัญญัติการจัดสรรที่ดิน พ.ศ. 2543 รวมทั้งระเบียบและกฎหมายอื่น ๆ ที่เกี่ยวข้อง เพื่อให้ทราบถึงปัญหาและอุปสรรคในการดําเนินงานของคณะกรรมการหมู่บ้านจัดสรร ทั้งนี้แม้พระราชบัญญัติการจัดสรรที่ดิน พ.ศ.2543 จะบัญญัติรองรับการดําเนินการของ คณะกรรมการหมู่บ้านจัดสรร แต่พระราชบัญญัติการจัดสรรที่ดินดังกล่าวก็ไม่ได้บัญญัติอํานาจหน้าที่และการควบคุมกํากับดูแลการปฏิบัติงานของคณะกรรมการหมู่บ้านจัดสรรให้จัดเจนและเข้าใจได้ดีพอที่จะทําให้สมาชิกในหมู่บ้านไว้วางใจในการมอบหมายอํานาจทั้งปวงให้กํากับดูแลแทนทั้งสมาชิกในหมู่บ้านอาจไม่เชื่อมั่นในศักยภาพของบุคคลที่เข้ามาดําเนินการในฐานะ คณะกรรมการหมู่บ้านจัดสรร ซึ่งเป็นเหตุผลหนึ่งที่ทําให้การบริหารจัดการงานของคณะกรรมการหมู่บ้านไม่ได้ประสิทธิผลที่ดีพอ และเมื่อนิติบุคคลหมู่บ้านจัดสรรได้รับความเสียหายหน้าที่หลักในการบํารุงรักษาและจัดการสาธารณูปโภคก็ย่อมกระทบไปด้วย เป็นผลให้นิติบุคคลหมูบ้านจัดสรรได้รับความเสียหายในที่สุด ดังนั้น งานนิพนธ์ฉบับนี้จึงมีข้อเสนอแนะว่า ควรจะมีการแก้ไขเพิ่มเติมกฎหมายและระเบียบที่เกี่ยวข้องเกี่ยวกับการดําเนินงานของคณะกรรมการหมู่บ้านจัดสรรให้มีอํานาจและหน้าที่ที่ชัดเจนและมากกว่าเดิม ลดข้อจํากัดบางประการเพื่อให้การบริหารจัดการของคณะกรรมการหมู่บ้านสัมฤทธิ์ผล รวมทั้งกําหนดหลักเกณฑ์และคุณสมบัติของบุคคลที่จะเข้ามาเป็นคณะกรรมการนิติบุคคลหมู่บ้าน เพื่อสร้างความเชื่อมั่นและเพื่อประโยชน์ในการบริหารจัดการของคณะกรรมการหมู่บ้านได้อย่างมีประสิทธิภาพ และเป็นไปตามเจตนารมณ์แห่งกฎหมาย

dc.description.abstractalternative	This study aims to examine the management problems and obstacles of housing estate committee under The Land Allocation Act, B.E. 2543 and other related regulations and laws. Although this act validates the committee’s performance, it does not specify the committee’s authority and supervision so clearly and understandably that the committee is trusted by housing estate members. Another cause is that the estate members do not rely on the committee member’s potential. This also obstructs the effectiveness of the housing estate committee’s performance. Once the juristic body’s reputation of the housing estate is impaired, its infrastructure maintenance and management function is negatively affected which eventually leads to the ruin of the juristic body of the housing estate. The suggestions are that there should be other law and regulation legislated to promote the authority of the committee. Some restrictions should be removed to facilitate the effectiveness of the committee’s performance. Requirements and qualifications of the committee member should be specified which will establish the committee’s trustworthiness and facilitate the effectiveness of the committee’s performance and the intendment of law.
