dc.description.abstract	ปัจจุบันคนไทยนิยมนําสัตว์ชนิดสายพันธุ์ต่างถิ่นเข้ามาไม่ว่าจะเป็นการเลี้ยงเพื่องานอดิเรก เลี้ยงเป็นธุรกิจ หรือเหตุผลอื่น ๆ ถ้าผู้ที่นําเข้ามาไม่มีความพร้อมขาดความรับผิดชอบ ก็อาจก่อให้เกิดปัญหาต่าง ๆ ตามมา เช่น โรคระบาด ปัญหาผสมพันธุ์ข้ามสายพันธุ์ ส่งผลกระทบต่อสัตว์พันธุ์พื้นเมือง ถือเป็นการคุกคามต่อความหลากหลายทางชีวภาพ ก่อให้เกิดความสูญเสียทาง สิ่งแวดล้อม เศรษฐกิจ สุขอนามัยของประชาชน งานนิพนธ์ฉบับนี้มีวัตถุประสงค์ เพื่อศึกษาปัญหาทางกฎหมาย แนวคิด ทฤษฎี เกี่ยวกับมาตรการทางกฎหมายในการควบคุมการเลี้ยงและปล่อยสัตว์ชนิดสายพันธุ์ต่างถิ่น และวิเคราะห์ ปัญหามาตรการทางกฎหมาย รวมถึงเสนอแนะให้มีการปรับปรุงแก้ไข จากการศึกษาพบว่ายังไม่มีกฎหมายที่เกี่ยวกับการเลี้ยงและปล่อยสัตว์ชนิดสายพันธุ์ต่างถิ่นไว้โดยเฉพาะจึงทําให้ไม่สามารถควบคุมสัตว์ชนิดสายพันธุ์ต่างถิ่นได้ หรืออาจเกิดปัญหาในการบังคับใช้กฎหมายทั้งในทางแพ่ง ทางอาญา หรือ อนุสัญญาว่าด้วยความหลากหลายทางชีวภาพในการปกป้องคุ้มครองพันธุ์สัตว์พื้นเมือง สภาพแวดล้อมภายในประเทศ ดังนั้นผู้ศึกษาจึงขอเสนอแนะแนวทางแก้ไขปัญหาให้มีการออกเป็นกฎหมายเฉพาะที่เกี่ยวข้องกับการเลี้ยงและปล่อยสัตว์ชนิดพันธุ์ต่างถิ่น ซึ่งในงานนิพนธ์ฉบับนี้ผู้ศึกษาได้เสนอร่างพระราชบัญญัติการเลี้ยงและปล่อยสัตว์ชนิดพันธ์ต่างถิ่นเพื่อเป็นแนวทางในการจัดการบริหารต่อไป

It may cause problems such as disease outbreaks, crossbreeding problems. Impact on native species. It is a threat to biodiversity. Cause environmental damage, public health, hygiene. This research aims to: To study legal problems, concepts, theories on legal measures in controlling the raising and release of alien species. And analysis of legal issues. Include suggestions for improvement. The study found that there are no laws regarding the breeding and release of species of exotic species, so it can not control the species of alien species. There may be problems with the enforcement of civil law or the Convention on Biological Diversity in the protection of native animals. Domestic environment. Therefore, the researcher suggested to solve the problem. There is a specific law governing the raising and release of alien species. In this thesis, the researcher proposed the draft of the raising and release of alien species as a guideline for management.
