dc.description.abstract	การประกอบกิจการขนส่งสินค้าทางทะเลในยุคปัจจุบันนั้น ผู้ประกอบการที่อยู่ในตลาดการให้บริการขนส่งสินค้าระหว่างประเทศอาจได้รับผลกระทบจากเศรษฐกิจโลกอันเป็นปัจจัยสำคัญต่อการขยายตัวของการค้าระหว่างประเทศ ดังเช่นกรณีของบริษัท ฮันจิน ชิปปิ้ง จากัด ซึ่งเป็นสายการเดินเรือชั้นนำของโลกที่ได้เข้าสู่กระบวนการล้มละลายอันเนื่องมาจากผลประกอบการที่ขาดทุนอย่างต่อเนื่องเป็นระยะเวลาหนึ่ง ข้อเท็จจริงในกรณีศึกษานี้ได้ก่อให้เกิดปัญหาต่าง ๆ ทั้งในส่วนที่เกี่ยวข้องกับสิทธิเรียกร้องระหว่างผู้ประกอบการภาคเอกชน อันได้แก่ สิทธิเรียกร้องระหว่างผู้ประกอบการนำเข้า-ส่งออก สิทธิเรียกร้องระหว่างผู้เอาประกันภัยหรือผู้รับโอนสิทธิจากผู้เอาประกันภัยและผู้รับประกันภัย และสิทธิเรียกร้องระหว่างผู้ส่งของ ผู้ขนส่ง และผู้รับตราส่ง นอกจากนี้ยังก่อให้เกิดข้อพิจารณาเกี่ยวกับมาตรการของรัฐเพื่อการแก้ไขและการป้องกันปัญหาที่พึงต้องได้รับการพิจารณาทบทวนว่ามาตรการเกี่ยวกับการดำรงหลักประกันเพื่อรองรับความรับผิดของผู้ขนส่งและมาตรการส่งเสริมอุตสาหกรรมพาณิชยนาวีของประเทศไทยนั้นมีอยู่อย่างเพียงพอและยั่งยืนหรือไม่	th_TH

dc.description.abstractalternative	At the present time, the business of carriage of goods by sea is likely to be affected by the world economic crisis which considerably impacts the international trade. One of the obvious circumstances is the case of Hanjin Shipping Co., Ltd. which has always been classified as global leader in liner shipping industry. However, Hanjin Shipping Co., Ltd. has entered the bankruptcy process due to the continuous loss in business for a period of time. The case study evoked problems in claiming between private entrepreneurs especially in import/export, insurance and transportation business. In addition to the promotion of maritime industry, the solution and preventive measures of Thailand for this kind of crisis are consequently questioned whether they are sufficient and sustainable particularly in terms of the financial collateral to cover carrier’s liability.	en
